Alameda County Users:
If you are efiling on
behalf of a minor who is under the Juvenile court jurisdiction
- petition for change of name
- petition for recognition of minor’s change of
gender and sex identifier
- petition for recognition of change of gender and
sex identifier (non-minor)
And the minor has a prior or current case in
juvenile court (dependency or delinquency), you must efile
the petition as a new case. Do not place Juvenile case number on the petition,
since they will get a new case number; instead submit CM015 Notice of Related
Case.

case" button.

Santa
Clara County Users: The Santa Clara Family Clerk's office is now accepting
Findings and Orders after hearings (FOAH) via E-file. We are asking that the
filer omit the EFS020 cover sheet and use the “Findings and Order after
Hearing” description when selecting the document in E-file. If your document is
submitted via e-file you will not need to email a copy of the FOAH to the
department. The FOAH will be accepted unfiled, forwarded to the Judicial
Officer for signature and E-served back, with a signature and filed stamp, to
the address listed on the document. Please take note of the following to help
minimize rejections
·
First, the e-filing process should be used only for
two types of FOAH at this point: (1) those for which both parties appeared at
the hearing, and the non-drafting party has signed off on the FOAH as conforming
to the court order made at the hearing; and (2) those for which only the
drafting party appeared at the hearing and there is not a need for the other
party to sign off on the FOAH.
o If
there is not an agreement to the FOAH, or if the drafting party is unable to
obtain the signature of the other party who appeared at the hearing, the FOAH
should not be sent through e-filing but should instead be submitted on paper
consistent with California Rules of Court, rule 5.125 (as has been the
procedure).
·
Second, if a FOAH is submitted through e-filing,
please do not leave the signature lines blank. FOAH submitted through e-filing
have the best chance of being approved if there are original or digital
signatures from both the drafting and non-drafting party.
o If,
however, the FOAH is being submitted without a signature in accordance with
California Rules of Court, rule 2.257(c)(1) and/or 2.257(c)(2)(A), please write
or type “SIGNATURE ON ORIGINAL – CRC 2.257(c)” on any signature line without an
original or digital signature.
o If
the non-drafting party did not appear at the hearing, please write or type
“PARTY DID NOT APPEAR AT THE HEARING” on the signature line for the other
party.
·
FOAH submitted without these designations on the
signature lines may be rejected by the clerk or the judicial officer since it
is often difficult to determine whether the FOAH should be approved when the
signature lines are left blank.
